Equine Release of Liability

WARNING

Under the Illinois Equine Activity Liability Act, each participant who engages in an equine activity expressly assumes the risks of engaging in and legal responsibility

for injury, loss, or damage to person or property resulting from the risk of equine activities. 

Intending to be legally bound hereby, User has signed this Equine Activities Waiver and Release as of the date set forth above.

In consideration of, and in return for, the use, today and on all future dates, of the any and all property, facilities, and services provided by Hold Your Horses, Inc. (“Provider”), and Provider’s employees, contractors and agents, User hereby warrants, represents, covenants and agrees as follows:

User acknowledges and agrees that there are inherent risks associated with equine activities such as described below.  Accordingly, User hereby expressly assumes all risks associated with participating in such activities. Risks of engaging in equine activities means those dangers of conditions that are an integral part of equine activities, including, but not limited to: (a) the propensity of an equine to behave in ways that may result in injury, harm or death to persons on or around them, including, without limitation, running, bucking, biting, kicking, shying, stumbling, rearing, stepping on or falling; (b) the unpredictability of an equine's reaction to sounds, sudden movement, and unfamiliar objects, persons, other animals, or other things; (c) certain hazards such as surface and subsurface conditions; (d) collisions with other equines or objects; (e) the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within his or her ability.  Accordingly, User assumes all risk in connection therewith and expressly waives any claims for any injury, damage or loss therefrom.  

User further acknowledges that the behavior of any animal is related to some extent upon the ability of User.  User warrants that User has fully disclosed User’s abilities to Provider.

Unless prohibited by applicable laws, User expressly releases Provider from any and all claims for personal injury or property damage, even if caused by the negligence of Provider or its representatives, employees or agents.

User agrees, at all times when on Provider’s premises, to abide by and follow Provider’s rules and regulations which shall be posted and/or available from time to time.
